Lost, wouldn't they go as "cell phone w/ battery" or due to the size do these devices not qualify?

Depends on the size. The general answer is dissection.
If it’s under 7 inches cell phone with battery is probably fine (need to ask Chris on that). Mega phablets still clear cell class, like the galaxy mega and the Spire Max. But anything larger isn’t considered a cell phone.
